In South Africa, it is usually the seller who appoints a conveyancer to attend to the transfer. A conveyancer is an attorney who has acquired additional conveyancing qualifications, which enable him to attend to the registration in the deeds office of the various transactions involving fixed property.

The deeds registry is open to any member of the public to access information

The deeds registry is open to any member of the public to access information with regard to the following:

  • the registered owner of a property
  • the conditions affecting such property
  • interdicts and contracts in respect of the property
  • purchase price of the property
  • rules of a sectional title scheme
  • a copy of an ante nuptial contract (ANC), deeds of servitude, mortgage bonds, etc.
  • a copy of a sectional title plan or the rules of a Sectional Title Scheme. (Note: this is not a certified copy; merely a copy for information purposes)
  • township establishment conditions
  • Information relating to a property or deed.

1. Failing To Respond

In fact, if you fail to put in a notice of your intention to defend, the case can be finalised without any further reference to you. This can cost you plenty.
